These Terms and Conditions (“Terms”) govern your access to and use of the Vapex UAE website and any related ordering, communication, customer support, and delivery services made available through it (collectively, the “Site”).
Vapex UAE is a business licensed in the United Arab Emirates, with registered address at Emirate Of Dubai and contact email info@vapexuae.com (“Vapex UAE”, “we”, “us”, or “our”).
By accessing the Site, creating an account, placing an order, or otherwise using any part of the Site, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not use the Site.
1. Adult-Only Access and Age Verification
The Site and all products offered through it are intended strictly for adults aged 18 years or older. By accessing the Site or placing an order, you represent and warrant that you are at least 18 years old.
Vapex UAE may request age and identity verification at any time, including before order acceptance, before dispatch, during delivery, after delivery, or whenever reasonably required for compliance, fraud prevention, account security, or restricted-product control.
We may refuse service, place an order on hold, cancel an order, or refuse delivery if age or identity cannot be verified to our satisfaction.
2. Business Model, Product Fulfilment, and Operational Structure
Vapex UAE operates as an online retail platform and may perform, coordinate, or arrange different parts of the order lifecycle through approved commercial arrangements with suppliers, fulfilment providers, logistics partners, delivery partners, and other service providers.
As part of these arrangements, certain products listed on the Site may be sourced, packed, processed, prepared, dispatched, or delivered through third-party operational channels designated by Vapex UAE. Vapex UAE remains the customer-facing contracting party for orders accepted through the Site unless expressly stated otherwise in writing.
3. Account Registration and Account Responsibility
To access certain features, you may be required to create an account or submit personal details. You agree to provide current, complete, and accurate information at all times.
You may not register, verify, or maintain an account using a phone number that does not belong to you or that you are not legally authorised to use. Vapex UAE may suspend or terminate any account and cancel related orders if we believe account information is inaccurate, misleading, unauthorised, or used in bad faith.
You are responsible for maintaining the confidentiality of your login credentials and for all activity carried out through your account.
4. Orders, Order Acceptance, and Order Cancellation
All orders placed through the Site are subject to review, verification, availability, and acceptance. Submission of an order does not automatically mean that the order has been accepted.
Vapex UAE may refuse, limit, split, hold, amend, or cancel any order at any stage, with or without prior notice, where reasonably necessary for age verification, identity checks, payment review, stock issues, pricing errors, product restrictions, suspected fraud, misuse, duplicate orders, operational limitations, delivery concerns, system errors, or compliance reasons.
If an order or part of an order is cancelled after payment has been captured, Vapex UAE will arrange a refund for the affected amount through the original payment method or another lawful method selected by Vapex UAE.
5. Pricing, Product Listings, and Availability
Vapex UAE aims to keep product listings, descriptions, availability, and pricing as accurate as reasonably possible. However, errors, delays, stock mismatches, image variations, listing inaccuracies, and technical issues may occur.
Prices, offers, stock visibility, and promotional conditions may change at any time before checkout without prior notice. A product appearing on the Site does not guarantee its availability at the time of your order.
If a product becomes unavailable after you place an order, Vapex UAE may contact you to offer a replacement, amend the order, issue store credit where agreed, or cancel the affected item or order and refund the relevant amount.
6. Payments and Authorised Use of Payment Methods
You confirm that any card, bank account, wallet, or other payment method used to place an order belongs to you or that you are fully authorised to use it for that transaction.
Vapex UAE may review transaction records, request supporting verification, delay acceptance, or cancel an order if we reasonably suspect unauthorised payment use, mismatched account details, fraud, chargeback risk, or any irregularity in payment activity.
7. No Purchases for Third Parties, Gifts, or Restricted Redistribution
Products sold through the Site are intended only for the verified adult purchaser’s own personal use, unless Vapex UAE expressly agrees otherwise in writing.
You may not place orders on behalf of another person, for onward supply, resale, gifting, proxy purchase, or transfer to any person whose age and identity cannot be verified by Vapex UAE.
Vapex UAE may refuse or cancel any order that appears to be intended for third-party supply, gifting, resale, unauthorised distribution, or restricted access circumvention.
8. Product Nature and Health Disclaimer
Products sold on the Site, including vape devices, e-liquids, nicotine salts, disposable vape products, replacement pods, coils, cartridges, and nicotine pouches, are adult-use consumer products.
Unless expressly stated otherwise by the manufacturer, no product sold on the Site is represented as a medicine, medical treatment, or a product intended to diagnose, treat, cure, or prevent any disease.
Use of nicotine-containing or inhalation-related products involves inherent risks. You agree that product use is your personal decision and responsibility, and that you should use all products only in accordance with product instructions, warnings, packaging guidance, and reasonable safety practices.
9. Communications, Service Messages, and Marketing
By creating an account, placing an order, submitting your contact details, starting a chat, or otherwise interacting with Vapex UAE, you authorise Vapex UAE to contact you for order processing, age or identity verification, account security, payment verification, delivery coordination, customer support, after-sales service, service announcements, and other transaction-related matters through phone calls, SMS, WhatsApp, Telegram, and email.
Vapex UAE may also send marketing, promotional, restock, launch, and offer-related communications where you have requested, subscribed to, opted in to, or otherwise validly agreed to receive such communications, or where such contact is otherwise permitted under applicable rules.
You may opt out of non-essential marketing communications at any time using the unsubscribe method provided, by replying to the relevant message where supported, or by contacting Vapex UAE customer support. Opting out of marketing communications does not prevent Vapex UAE from sending essential transactional or service-related messages relating to your orders, account, or compliance checks.
10. Delivery Area, ETAs, Failed Delivery, and Returned Orders
Vapex UAE primarily serves the United Arab Emirates, including Abu Dhabi, Dubai, Sharjah, Ajman, Ras Al Khaimah, Umm Al Quwain, and Fujairah.
Vapex UAE may, at its sole discretion, accept selected international orders. Any such order may be subject to additional written terms, payment conditions, verification procedures, shipping arrangements, destination restrictions, and handling requirements communicated before dispatch.
Estimated delivery times shown on the Site are estimates only. Vapex UAE will use commercially reasonable efforts to meet them, but delivery times are not guaranteed and may be affected by stock timing, supplier processing, weather, traffic, verification holds, peak periods, public holidays, remote locations, or third-party courier delays.
You are responsible for providing accurate name, phone number, delivery location, landmark details, access instructions, and any other information necessary for successful delivery.
If a delivery fails, is delayed, is returned, or requires reattempt because of incorrect details, unresponsiveness, refusal to cooperate with verification, refusal to show ID where requested, inaccessible location, or customer unavailability, Vapex UAE may charge additional delivery, re-delivery, handling, or return-processing fees, even if the original order qualified for free delivery.
11. Lost Parcels and Delivery Responsibility
If a parcel is confirmed lost before successful delivery and the loss is directly attributable to Vapex UAE or its designated fulfilment or delivery chain, Vapex UAE may, at its discretion, replace the lost items, provide store credit, or issue a refund for the affected amount.
Vapex UAE shall not be responsible for loss, failed delivery, or resulting costs where the issue arises from inaccurate address details, unreachable contact details, refusal of delivery, failure to complete verification, failure to provide required identification, or customer instructions that materially contribute to delivery failure.
12. Returns, Exchanges, and Refunds
Due to hygiene, product integrity, consumer safety, and the sensitive nature of age-restricted products, many products sold on the Site are non-returnable and non-exchangeable once dispatched or delivered, except where required by law or where Vapex UAE supplied the wrong item or the item was materially damaged due to handling attributable to Vapex UAE.
Unless otherwise stated, unopened vaping devices may be eligible for return or exchange within fourteen (14) days from delivery only if all of the following conditions are met:
- the device is unused;
- the original seal is intact;
- the item is not damaged;
- the product is returned in full original packaging with all accessories, inserts, labels, and proof of purchase;
- the item remains in a condition suitable for resale.
E-liquids, nicotine salts, coils, replacement pods or cartridges (whether prefilled or refillable), disposable vape products, opened nicotine pouches, and similar consumable items are generally not eligible for return or exchange once dispatched or delivered, except in cases of incorrect supply, dispatch error, or damage attributable to Vapex UAE.
Return shipping, collection, inspection, restocking, or reverse-logistics arrangements may be required before any refund or exchange is approved.
13. Product Performance, Defect Review, and Claim Handling
Vapex UAE supplies authentic products obtained through approved commercial channels to the best of its knowledge. However, certain products, especially consumables and electronically sensitive items, may be affected by manufacturer batch variation, transport conditions, storage sensitivity, charging practices, priming method, usage style, or handling after delivery.
Claims based solely on flavour preference, expected sensation, normal product depletion, coil burnout, pod burnout, leakage caused by misuse or handling, condensation, charging misuse, improper storage, or use contrary to instructions may be declined.
Where a genuine issue is reported and Vapex UAE determines that the issue more likely than not arose during Vapex UAE’s acceptance, packing, storage, coordination, or delivery process, Vapex UAE may offer a replacement, refund, store credit, or other reasonable remedy at its discretion and in accordance with applicable law.
14. Coupons, Promotions, and Offers
Coupons, discounts, bundle offers, free delivery campaigns, referral promotions, flash deals, and other incentives may be offered from time to time and are subject to their own stated conditions, including expiry dates, order thresholds, excluded products, account limitations, territory limitations, and anti-abuse rules.
Vapex UAE may reject, remove, reverse, or cancel any promotion, discount, or coupon where the stated conditions are not satisfied, where misuse is suspected, or where a technical or pricing error has occurred.
15. User Conduct
You agree not to misuse the Site, interfere with its operation, submit false information, impersonate another person, attempt unauthorised payment use, exploit promotions, create duplicate or deceptive accounts, or use the Site in any way that may harm Vapex UAE, its customers, suppliers, service providers, or systems.
16. Intellectual Property
All content on the Site, including text, product copy, page layout, graphics, logos, icons, videos, audio, photographs, software elements, design assets, and compilations, is owned by Vapex UAE or licensed to it and is protected by applicable intellectual property laws.
You may not copy, reproduce, republish, distribute, modify, scrape, frame, commercially exploit, or otherwise use any Site content without Vapex UAE’s prior written consent.
17. Privacy and Data Use
Vapex UAE may collect, use, store, review, and process personal information that you provide or that is generated through your use of the Site for purposes including account management, order processing, age verification, fraud prevention, payment review, delivery coordination, customer support, product improvement, legal compliance, and communications.

18. Limitation of Liability
To the fullest extent permitted by applicable law, Vapex UAE shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential loss, including loss of profit, loss of opportunity, loss of goodwill, or business interruption, arising out of or in connection with the use of the Site or any product purchased through it.
Vapex UAE’s total liability in relation to any accepted order shall, to the fullest extent permitted by law, be limited to the amount paid by the customer for the specific affected product or order giving rise to the claim.
Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.
19. Changes to These Terms
Vapex UAE may update or modify these Terms from time to time. The latest version published on the Site shall apply from its stated effective date. Continued use of the Site after an update constitutes your acceptance of the revised Terms.
20. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the United Arab Emirates and the applicable laws and regulations in force in the Emirate of Dubai. Any dispute arising out of or in connection with these Terms or the Site shall be subject to the jurisdiction of the competent courts of Dubai, unless mandatory law requires otherwise.
